Domain Name Dispute

The attorneys at Clark and Allen, PC have a broad range of experience and knowledge to draw upon to assist you with your domain name dispute matters. In today's world of increasing online business, your domain name can be a very valuable asset for your company, sometimes the most valuable asset. Your domain name is often times the easiest and most prominent way that the world recognizes you and your products or services. Whether you have discovered someone stealing your domain name and/or improperly using a very similar one to reap the benefits of your reputation and good will, or if you have been the target of a domain name dispute and believe you have valid rights to that name, we can efficiently and effectively counsel you on your matter. We understand that a domain name dispute resolution proceeding is typically new territory for our clients; and we can help navigate you through this unfamiliar process.

If you have discovered an offending party against whom you would like to file a Uniform Domain Name Dispute Resolution (UDRP) Complaint, we can assist you in drafting and filing such a Complaint. If online traffic and business is a key component of your business, or perhaps the only component, violations of UDRP policy can be severely damaging to your bottom line. We understand that our clients have invested significant time, money and effort into building value in the recognition of their names and marks; and the last thing that our clients want is for someone to improperly take advantage or benefit from those investments. Everyday, cybersquatters or infringing businesses seek to benefit from other people's hard work. An option that is less time consuming and less expensive than litigation in court, but has the potential of being very effective, is the filing of a UDRP Complaint. Our attorneys can help you decide if this is a favorable option for you; and if you choose this option, we can draft and file a strong UDRP Complaint on your behalf and seek to obtain the domain name that infringes on your name and mark.

On the other hand, if you have received a UDRP Complaint and need to respond to the Complaint, our attorneys can analyze your situation and help you draft a strong response to such a Complaint. Many times these disputes are focused on trademark law. We have assisted many clients with their trademark law issues and can use that knowledge to find an efficient and effective strategy to handle the Complaint. In some instances, the party filing the Complaint may believe they have a valid claim to your domain name; however, they may be mistaken. In other instances, the party filing the Complaint may be improperly using the UDRP procedures in the hopes of disrupting your competing business. Whatever the motive for the Complaint being filed against you, we at Clark and Allen, PC can help you understand your options and explore the possibility of drafting a response. If you have received a UDRP Complaint, we do suggest that you contact a lawyer as soon as possible as there is a short time limit within which to respond to the Complaint.
